Investigating Sexual Harassment Complaints: Common Challenges, Practical Solutions, and Recent Developments

Sexual harassment complaints continue to be among the most challenging matters to investigate in the workplace. This session will review recent court and tribunal decisions and share practical takeaways that can help investigators avoid common missteps when handling sexual harassment complaints. Drawing on the presenters’ experience conducting sexual harassment investigations, as well as a review of recent legal developments, the session will examine common challenges such as scoping complaints, assessing credibility and making factual findings in the absence of direct witnesses, and mitigating the impact of stereotypes and unconscious bias. Particular attention will be paid to how trauma-informed principles can be integrated into the investigative process while maintaining fairness and impartiality. Attendees will leave with concrete guidance on responding to sexual harassment complaints in a manner that is fair, thoughtful, and legally defensible.
