Investigating Sexual Harassment Complaints: Common Challenges, Practical Solutions, and Recent Developments

Sexual harassment complaints continue to be among the most challenging matters to investigate in the workplace. This session will review recent court and tribunal decisions and share practical takeaways that can help investigators avoid common missteps when handling sexual harassment complaints.

Drawing on the presenters’ experience conducting sexual harassment investigations, as well as a review of recent legal developments, the session will examine common challenges such as scoping complaints, assessing credibility and making factual findings in the absence of direct witnesses, and mitigating the impact of stereotypes and unconscious bias.

Particular attention will be paid to how trauma-informed principles can be integrated into the investigative process while maintaining fairness and impartiality. Attendees will leave with concrete guidance on responding to sexual harassment complaints in a manner that is fair, thoughtful, and legally defensible.

Where the Rubber Meets the Road: When Your Founded Investigation Poses Legal Liabilities

There will be times in any workplace or administrative investigator’s career where the discovery of truth exposes their client or organization (who are paying for the investigation) to legal liabilities. When the evidence supports a finding that an individual or individuals has seriously breached policies or law designed to protect others, it is that evidence and the subsequent report, that may be utilized in a lawsuit.

As an investigator discovers evidence of serious misconduct, gross mismanagement, or even internal interference in their investigation, what should they do?

Compounding the challenges is the natural conflict of interest when an internal or external lawyer, whose role is to protect the organization, are either conducting or overseeing the investigation.

In this session, Bob Stenhouse will share from case study experiences and first asks the provocative question: Do we compromise on truth, when it exposes individuals or organizations to liabilities?
